Stafford Web Project - Terms and Conditions
The Stafford Web Project is a promotional initiative operated by DACCAA Ltd (Company No: 14639674), a company
registered in England and Wales. By applying for this promotion, you ("the applicant") agree to the following
Terms and Conditions, which form a legally binding agreement between you and DACCAA Ltd.
1. Project Nature and Scope
- The Stafford Web Project is a DACCAA Ltd initiative offering free one-page brochure websites to eligible local
businesses and charities.
- This offer does not include complex functionality such as online shops, bespoke booking systems, or membership
systems.
- Additional features may be available at extra cost. All such costs will be clearly communicated and agreed upon in
advance before any work is undertaken.
2. Eligibility and Application
- DACCAA Ltd reserves the absolute right to reject any application at its sole discretion, without providing a
reason.
- We may store and process your details until a decision is made, until we have capacity to begin the build, or
until your application is formally rejected.
- You are applying for a promotional offering and not entering into a standard contract of sale.
3. Fair Use During Website Development
- DACCAA Ltd reserves the right to terminate development if a client becomes unreasonably demanding, aggressive,
unresponsive, or breaches fair use of our time and resources.
- Fair use includes reasonable response times, professional and respectful communication, and realistic
expectations of a free promotional offering.
4. Maintenance Plan and Charges
- Participation in this promotion requires a 12-month minimum maintenance contract at a rate of £29/month,
payable by direct debit or other agreed method.
- After 12 months, your plan may be renewed at the same or a similar rate, or rolled over to a non-contracted
plan at £39/month with no further commitment.
- We reserve the right to waive early termination penalties in cases of genuine business hardship or closure, on
a case-by-case basis.
5. Ownership and Rights
- DACCAA Ltd retains full ownership of the website until the 12-month maintenance contract has been completed.
- After completion of the contract, full rights to the website are transferred to you.
- Domain names may be registered in our name and transferred to you upon request, subject to any external
registrar policies (such as 60-day locks).
6. Data Protection and GDPR
- Your data will be processed in accordance with the UK GDPR and Data Protection Act 2018.
- We collect only necessary data for eligibility and service delivery, including contact information and
business details.
- We do not sell, rent, or otherwise share your data without explicit permission, unless required by law.
- You may request access to or deletion of your data at any time, subject to our contractual or legal
obligations.
7. Payments and Debt Collection
- If an invoice remains unpaid for six months, and there has been no meaningful progress toward payment — including
cases where communication has been made but no payment or arrangement has occurred — we reserve the right to refer
the matter to a third-party debt collection agency.
- You will be liable for any additional fees or costs incurred as a result of debt recovery action.
8. Liability and Indemnity
- DACCAA Ltd, its employees, and directors (including Danny Franklin and Ethan Westwood) shall not be held
liable for any damages or losses arising from use of the website or services.
- This includes but is not limited to: data loss, downtime, reputational harm, loss of earnings, or third-party
service failure.
- You accept full responsibility for all content provided or approved by you.
9. Modifications and Termination
- DACCAA Ltd reserves the right to modify these terms at any time. Changes will be posted to our website.
- You will be notified of material changes and may terminate your agreement if you disagree with new terms.
10. Governing Law
- These Terms shall be governed and interpreted in accordance with the laws of England and Wales.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
